Terms & Conditions of Sale

These Terms and Conditions ("Terms") govern the sale of all products by Indoor Outdoor Spas ("we", "us", "our", "Indoor Outdoor Spas") through our website, showrooms and any other sales channels. By placing an order with us, you agree to be bound by these Terms.

1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law (ACL), including the Consumer Guarantees.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

•       A replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage

•       Repairs or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure

2. Orders and Acceptance

An order is not binding on Indoor Outdoor Spas until we have confirmed acceptance of your order in writing or issued a tax invoice. We reserve the right to decline any order at our discretion.

For spa and swim spa purchases, a deposit is required to confirm your order. The deposit amount and balance payment terms will be set out in your Sales Agreement.

We reserve the right to cancel an order due to pricing errors, stock unavailability or other circumstances beyond our control. If an order is cancelled, any deposit paid will be refunded in full.

3. Pricing and Payment

All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice.

Payment methods accepted include credit/debit card, bank transfer and other methods as specified at the time of purchase. Finance options may be available for qualifying purchases.

For major purchases (spas and swim spas), the payment schedule will be set out in your Sales Agreement and may include:

•       A deposit upon order confirmation

•       Progress payments as specified

•       Balance due prior to or upon delivery

4. Product Information

We take reasonable care to ensure product descriptions, specifications and images on our website are accurate. However:

•       Colours, finishes and materials may vary slightly from images shown due to photography, screen settings and manufacturing variances

•       Product specifications may change without notice due to manufacturer updates

•       Images are for illustrative purposes only and may show optional accessories or features not included in the base price

We encourage you to visit our showroom to inspect products in person before purchasing.

5. Delivery

Delivery timeframes provided at the time of purchase are estimates only and may vary due to manufacturing lead times, shipping delays or other factors beyond our reasonable control. We are not liable for any loss or damage arising from delivery delays.

It is your responsibility to ensure that:

•       The delivery site is accessible for the delivery vehicle and equipment required

•       A responsible adult is present to accept delivery

•       Site access is clear and free of obstructions

Additional delivery costs may apply for difficult access, remote locations, failed delivery attempts or rescheduling at your request. These costs will be communicated to you in advance where possible.

Risk of loss or damage to the product passes to you upon delivery.

6. Installation and Electrical Requirements

Installation services are available and are subject to a separate quotation and agreement. If installation is included in your purchase, the scope of work will be specified in your Sales Agreement.

You are responsible for:

•       Ensuring the installation site is prepared and ready in accordance with our site preparation guidelines prior to the agreed installation date

•       Ensuring electrical connection is performed by a licensed electrician in compliance with all relevant Australian Standards and local regulations

•       Obtaining any permits or approvals required by your local council or body corporate prior to installation

We are not responsible for any delays, additional costs or damage arising from the site not being ready, electrical non-compliance or failure to obtain required permits. Any additional site visits required as a result may incur additional charges.

7. Title and Risk

Ownership (title) of goods remains with Indoor Outdoor Spas until full payment is received. Risk of loss or damage passes to you upon delivery, regardless of whether full payment has been made.

Until title passes to you, you must store goods safely, keep them insured, and not deal with them in a way that may prejudice our interest.

8. Warranties

Products are covered by manufacturer warranties as specified in the warranty documentation provided with your purchase. Warranty terms, duration and coverage vary by product and brand.

Manufacturer warranties are in addition to, and do not limit, your rights under the Australian Consumer Law.

Warranties do not cover:

•       Damage caused by misuse, neglect, improper installation or failure to follow the manufacturer's instructions

•       Normal wear and tear

•       Damage caused by incorrect water chemistry or failure to maintain water quality

•       Cosmetic damage that does not affect the function of the product

•       Damage caused by unauthorised modifications or repairs

9. Returns and Refunds

Please refer to our separate Returns & Refund Policy, which is incorporated into these Terms by reference.

For spa and swim spa purchases, returns and cancellations are governed by the terms of your individual Sales Agreement.

10. Limitation of Liability

To the maximum extent permitted by law and subject to your rights under the Australian Consumer Law:

•       We are not liable for any indirect, incidental, special or consequential loss or damage arising from your purchase or use of our products

•       Our total liability to you for any claim is limited to the price paid for the relevant product

Nothing in these Terms excludes or limits our liability for fraud, personal injury or death caused by our negligence, or any liability that cannot be excluded or limited by law.

11. Dispute Resolution

If you have a complaint or dispute, please contact us in the first instance to attempt resolution. We aim to respond to all complaints within 5 business days.

If a dispute cannot be resolved, either party may refer the matter to a relevant dispute resolution body or tribunal in their state or territory.

12. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is available on our website.

13. Governing Law

These Terms are governed by the laws of the State in which the relevant transaction is conducted, and the parties submit to the non-exclusive jurisdiction of the courts of that State.
